Donation Policies, Terms, and Conditions
Acceptance of any contribution, gift or grant is at the discretion of the Atlanta Youth Soccer Foundation. The Atlanta Youth Soccer Foundation will not accept any gift unless it can be used or expended consistently with the purpose and mission of the Atlanta Youth Soccer Foundation.
No irrevocable gift, whether outright or life-income in character, will be accepted if under any reasonable set of circumstances the gift would jeopardize the donor’s financial security.
The Atlanta Youth Soccer Foundation will refrain from providing advice about the tax or other treatment of gifts and will encourage donors to seek guidance from their own professional advisers to assist them in the process of making their donation.
The Atlanta Youth Soccer Foundation will accept donations of cash or publicly traded securities. Gifts of in-kind services will be accepted at the discretion of the Atlanta Youth Soccer Foundation.
Certain other gifts, real property, personal property, in-kind gifts, non-liquid securities, and contributions whose sources are not transparent or whose use is restricted in some manner, must be reviewed prior to acceptance due to the special obligations raised or liabilities they may pose for Atlanta Youth Soccer Foundation.
The Atlanta Youth Soccer Foundation will provide acknowledgments to donors meeting tax requirements for property received by the charity as a gift. However, except for gifts of cash and publicly traded securities, no value shall be ascribed to any receipt or other form of substantiation of a gift received by Atlanta Youth Soccer Foundation.
The Atlanta Youth Soccer Foundation will respect the intent of the donor relating to gifts for restricted purposes and those relating to the desire to remain anonymous. With respect to anonymous gifts, the Atlanta Youth Soccer Foundation will restrict information about the donor to only those staff members with a need to know.
The Atlanta Youth Soccer Foundation will not compensate, whether through commissions, finders' fees, or other means, any third party for directing a gift or a donor to the Atlanta Youth Soccer Foundation.
Donation Refund Policy
ATLANTA YOUTH SOCCER FOUNDATION (“AYSF”) is dependent upon the generosity of public and private donations to pursue our mission. We are exceedingly grateful to those who share our passion and partner alongside us (“Donors”). As such, AYSF desires to adhere to the highest ethical standards, committing to honor donor intent as well as honor the public interest entrusted to us as a 501(c)(3).
Subsequently, in order to protect the trust placed upon us by the public as a tax exempt organization, we must strictly adhere to a policy that does not allow for refunds of donations, except under very special circumstances as outlined below.
1) Violation of Gift Agreement
When a donation exceeding $100,000 is given, AYSF may engage with the Donor through a written Gift Agreement. The purpose of the Agreement is to document how AYSF intends to utilize the gift. Such an Agreement will allow the Donor to approve or modify the intended use of funds before they are utilized. Once signed by the Donor, a refund cannot be considered unless it is determined that AYFS has violated the terms of the Agreement.
2) Failure to Honor Donor Intent
When making a donation, if the Donor requests in writing how they specifically wish their donation to be utilized (e.g., player registration and travel, facilities, uniforms, equipment, transportation), AYSF will make every effort to honor their request and utilize their donation in a fashion consistent with their wishes. A refund may be considered if AYSF fails to honor the written intent of the Donor.
AYSF will only consider refunding a donation if such a request is made within fifteen (15) days of the original donation during the calendar year in which the donation was made - unless otherwise agreed upon in writing - provided the donor has not claimed a tax deduction from their donation (proof of tax return may be required).
In order to fulfill the responsibility granted to AYSF by the public as a tax-exempt organization, donation refund requests for any other reason cannot be considered.
Donor Privacy Policy
ATLANTA YOUTH SOCCER FOUNDATION (“AYSF”) will not sell, share or trade our donors’ names or personal information with any other entity, nor send mailings to our donors on behalf of other organizations.
This policy applies to all information received by AYSF, both online and offline, on any Platform (‘Platform’, includes the AYSF website and mobile applications), as well as any electronic, written, or oral communications.
To the extent any donations are processed through a third-party service provider, our donors’ information will only be used for purposes necessary to process the donation.
Data Security
Controls
ATLANTA YOUTH SOCCER FOUNDATION (“AYSF”) will maintain reasonable administrative, technical, and physical controls designed to protect data in its possession or under its control from unauthorized access, accidental loss and unauthorized modification.
PCI-DSS
AYSF utilizes Stripe as a third-party payment processing gateway. Stripe will make reasonable efforts to provide services in a manner consistent with PCI-DSS requirements that apply to Stripe.
Compromise or Data Breach
AYSF will notify donors of reported third-party payment processor data compromises or breaches directly affecting AYSF’s donors. Additionally, AYSF will report data compromises or breaches of systems operated or maintained by AYSF (e.g.: website).
